Getting Ripped off by Ebay sellers.

So once again I've been ripped off by an ebay seller... I bought an exhaust a few days ago after having conversation with the seller on the phone and him assuring me it was is good condition and just had some minor cosmetic damage. Here is the listing...

'Complete exhaust in good condition from my 2002 Nsr 125 the can has some scrapes along it but the pipe itself is in very good condition only done 9000.00 miles pads included

Now here are the pictures. Excessive rust, end can scraped down to the steel on the edge and the hanger is only half attached, not happy.

I'm asking for a full refund and for them to arrange a courier to pick it up.
 
The item doesn't match the description and you're more than covered on long distance trading laws anyway.

Let us know if they cause you a fuss. Some of us have experience with this stuff after CurlyBlakeyBikers Canadian video sunglasses issue.
 
same thing happened to me i bought a exhaust for my bike photo of the right exhaust then i when i opened it was the one for the newer bike and he said he would refund but apparently i have to pay the postage back to him even thou it was completely false advertising.


myself i would request £35-40 back and say that is to fix the exhaust or i want a full refund, if you get some money back then wire wool the exhaust down and respray it with some bbq paint.

I'm pretty certain under long distance trading laws you don't have to pay the postage for sending it back.

Look into it first. There's so many laws on it.

Send it back.

If he refuses to accept it back get Ebay involved.

He should arrange Collection & Delivery or he should return the postage costs.

Your entitled to send it back. You have the same right as someone walking into a store & looking at something before you purchase it.

If your unhappy get intouch & send it back. Do not pay for postage it's his mistake for listing the item as he did.

The words 'very good condition' & it comes with a broken hanger + Lots of surface rust. Get rid.

Unless you want to sort it out with the seller? Maybe give you some money off, so you can get it spot welded & re-painted? Just a thought, keep us posted.
 
Thank you all for the advice! As of now I am still awaiting his response to my email (I sent it through ebay to make sure it is recorded).
At first I thought about asking for some money for repairs but I'm so hacked off by it that I don't want him making any money out of me.

I'll keep you all posted and appreciate the help :)
 
The best advice i can give (as Friz said i'm quite experienced in these matters) is to never give any impression you're backing down, make it clear you're willing to go as far as neccesary to get your money back. In my experience eBay customer support are good at their job, and they will side with you in this situation. Good luck!
 
I don't think I would have started with asking for a refund. I would have started with going through Ebay first. Then you get your money back, you probably get to destroy the item, and he gets a huge black mark on his record (if they even let him keep it.) Simply accepting a refund and sending it back to him is just a slap on the wrist and will let the douchebag do it to someone else.

I'd be taking it up with ebay and paypal. Both have extensive procedures for this kind of thing. The guy sent you a BROKEN item which was falsely advertised. Throw the book at him.

Same. That exhaust is clearly not in 'very good condition'.
 
Thanks again for your advice, He has responded to my email politely but i think I'm decided on my action, I'll take it through ebay. What would you guys do following this responce?

The NSR Exhaust arrived today, it was well packaged but I'm not happy with it at all. You described it as being in very good condition with a scratch down the side but it's completely knackered... The downpipe is incredibly rusty and the hanger is only half attached as the weld has split.

I thought I would contact you to offer the chance to make amends before taking it through ebay. Please could you refund all the money and pay for a courier to return it to you?

Hi I am sorry your not happy with the item, The exhaust is not knackered. the rust around the down pipe is quite normal for a pipe thats 12 years old I am happy for you to return it for a full refund of the purchase price but the p&p is r]at your expense. many thanks I await confirmation of your action.
 
The guy lied. Plain and simple. If anything he should be offering you some compensation for the time you're going to have to spend to get it back to him and collect your refund. It's time to go through the proper channels with eBay and PayPal if applicable.
 
I've opened a case on ebay, the guy has until April 11th to sort it out before I can contact customer support. I made sure to quote The Consumer Protection (Distance Selling) Regulations 2000 with the hope of silencing any argument about P&P from his side.
 
Ebay have said I have to return it and return postage is at my expence... £12.50 for nothing? Im really pissed off about this.

Common i'm afraid, i think it works like a carrot on a stick, by not incurring any more cost to the seller it makes them more likely to accept the item back for a refund
